MEMBERSHIP AGREEMENT
A QUICK NOTE BEFORE WE GET INTO THE DETAILS
We want our memberships to be simple, fair and transparent.
Memberships allow us to offer better ongoing value than casual visits and class packs, while giving you more structure and consistency in your training.
Our Pilates & Movement memberships are flexible ongoing weekly memberships with no minimum term.
Our Personal Training Circle memberships work a little differently. Because they include an initial assessment, goal setting, individual programming and a regular reserved training place, they begin with a 12-week minimum commitment.
Everything important is explained below in plain English. Please read this agreement before joining, and if something isn't clear, ask us before you sign up.
1. YOUR MEMBERSHIP
This agreement applies to the Fearless Movement membership you select when joining.
Your purchase screen will show:
your membership type;
what is included;
your weekly membership price; and
your payment frequency.
Your membership entitlements are those specified in the membership you purchase.
PILATES & MOVEMENT MEMBERSHIPS
1 Class Per Week — $23/week
Includes one Pilates & Movement class each week and the ability to carry forward a maximum of one unused class.
2 Classes Per Week — $40/week
Includes two Pilates & Movement classes each week.
3 Classes Per Week — $50/week
Includes up to three Pilates & Movement classes each week.
Pilates & Movement members may purchase additional Pilates & Movement classes for $20 per class, subject to availability.
PERSONAL TRAINING CIRCLE MEMBERSHIPS
1 Circle Per Week — $75/week
Includes:
1 Personal Training Circle each week;
1 Pilates & Movement class each week;
initial assessment and goal setting;
individualised training program;
ongoing program adjustments;
regular check-ins and progress tracking;
health and fitness coaching and support; and
program and goal reviews.
Additional Pilates & Movement classes may be purchased for $15 per class, subject to availability.
2 Circles Per Week — $115/week
Includes:
2 Personal Training Circles each week;
2 Pilates & Movement classes each week;
initial assessment and goal setting;
individualised training program;
ongoing program adjustments;
regular check-ins and progress tracking;
health and fitness coaching and support;
6-week mini review; and
comprehensive 12-week program and goal review.
Additional Pilates & Movement classes may be purchased for $15 per class, subject to availability.
2. MEMBERSHIP TERMS AND COMMITMENTS
PILATES & MOVEMENT MEMBERSHIPS
Pilates & Movement memberships have no minimum commitment period.
Your membership begins when you join and continues week to week until you choose to cancel it.
You can cancel at any time by providing at least 7 days' written notice.
PERSONAL TRAINING CIRCLE MEMBERSHIPS
Personal Training Circle memberships begin with a 12-week minimum commitment.
This is because your Circle membership involves more than attendance at a group session. We invest time at the beginning of your membership in assessment, goal setting and developing your individual training program, and a regular place in a small Circle is reserved for you.
The 12-week period also provides a meaningful block of time to train consistently, progress your program and work towards your health and fitness goals.
You are welcome to give notice during your initial 12 weeks that you don't want your membership to continue. Provided we receive at least 7 days' written notice, your membership can finish at the end of your 12-week minimum period.
You don't need to wait until Week 12 to tell us.
If you don't cancel, your Circle membership will automatically continue on a week-to-week basis after the initial 12 weeks.
There is no new minimum commitment or lock-in period after the first 12 weeks.
3. SEVEN-DAY COOLING-OFF PERIOD
We voluntarily provide a 7-day cooling-off period from the date you first purchase a membership.
If you change your mind during those 7 days, let us know in writing and we will cancel the membership.
If you have already attended or used services during the cooling-off period, we may deduct the easonable value of services already supplied before refunding any remaining amount.
This voluntary cooling-off period does not limit any additional rights you may have under Australian Consumer Law.
4. CANCELLING YOUR MEMBERSHIP
PILATES & MOVEMENT MEMBERSHIPS
You can cancel your Pilates & Movement membership at any time by providing at least 7 days' written notice.
PERSONAL TRAINING CIRCLE MEMBERSHIPS
During the initial 12-week commitment, your Circle membership will ordinarily continue until the minimum commitment has been completed.
You can give notice before the end of the 12 weeks so that your membership finishes at the end of your minimum commitment.
After completing your initial 12 weeks, you can cancel your Circle membership at any time by providing at least 7 days' written notice.
Cancellation simply needs to be provided in writing using one of Fearless Movement's nominated contact methods so there is a clear record of your request.
We don't want to make cancelling deliberately difficult.
EXCEPTIONAL CIRCUMSTANCES
We understand that circumstances sometimes change in ways that couldn't reasonably have been anticipated.
If significant illness, injury, relocation or another exceptional circumstance means you can't reasonably complete your initial Circle commitment, please contact us.
Fearless Movement may agree to end the membership early or make another reasonable arrangement based on the circumstances.
Nothing in this agreement limits any cancellation, refund or other rights you may have under Australian Consumer Law.
5. MEMBERSHIP HOLDS
Memberships can be placed on hold for a minimum of 7 days.
For planned holds, please provide at least 7 days' written notice.
There is no set annual maximum on membership holds.
For Pilates & Movement memberships, billing will pause for the approved hold period and resume when the hold finishes.
If you place a Personal Training Circle membership on hold during its initial 12-week commitment, the minimum commitment period will be extended by the length of the hold.
For example, if you take a one-week hold during your initial 12 weeks, your minimum commitment will finish one week later.
UNEXPECTED ILLNESS, INJURY OR EXCEPTIONAL CIRCUMSTANCES
Some things can't be planned seven days ahead.
If illness, injury or another exceptional circumstance means you're temporarily unable to participate, contact us as soon as reasonably possible.
Where appropriate, Fearless Movement may waive the usual 7-day notice requirement and place your membership on hold.
Holds will not ordinarily be backdated for missed sessions unless Fearless Movement agrees that the circumstances justify doing so.
6. PILATES & MOVEMENT MEMBERSHIP BOOKINGS
Pilates & Movement memberships provide the number of weekly classes included in the membership purchased.
Classes are subject to timetable availability and capacity, so membership does not guarantee a place in a particular class unless that class has been booked.
1 CLASS PER WEEK MEMBERSHIP ROLLOVER
Members on the 1 Class Per Week membership may carry forward a maximum of one unused class.
Only one rollover class may be held at any time. Additional unused classes do not continue to accumulate.
A class lost because of a late cancellation or no-show does not become a rollover class.
The 2 Classes Per Week and 3 Classes Per Week memberships do not currently include rollover classes.
ADDITIONAL CLASSES
Pilates & Movement members may purchase an additional class for $20, subject to class availability.
Personal Training Circle members may purchase an additional Pilates & Movement class beyond the number included in their Circle membership for $15, subject to class availability.
7. PILATES & MOVEMENT CLASS CANCELLATIONS AND NO-SHOWS
We understand that plans change. If you can't attend a Pilates & Movement class, please cancel your booking as early as possible so somebody else has the opportunity to use the place.
8 HOURS OR MORE BEFORE CLASS
If you cancel at least 8 hours before the scheduled class time:
casual and pack holders retain the applicable class credit; and
membership holders can use their weekly entitlement for another available class, subject to their membership conditions and class availability.
LESS THAN 8 HOURS BEFORE CLASS
A cancellation made less than 8 hours before class is considered a late cancellation.
For casual purchases and class packs, the class is forfeited.
For memberships, the class is treated as used and isn't returned to the member's weekly allocation.
NO-SHOWS
If you book a class and don't attend without cancelling, the class is treated in the same way as a late cancellation.
We know genuine emergencies happen. Fearless Movement may make exceptions where we consider it reasonable in the circumstances.
8. PERSONAL TRAINING CIRCLE ATTENDANCE
Personal Training Circles work differently from general Pilates & Movement classes.
Your membership reserves a regular place for you in a small Circle. Your training program and coaching are planned around you, and that place remains reserved whether or not you attend on a particular week.
For that reason, missed Circle sessions do not accumulate, roll over or automatically create an entitlement to a make-up session.
There is no late-cancellation fee or 8-hour cancellation rule for Circle sessions. If you can't attend, the session is normally forfeited unless a suitable swap or alternative Circle place can be arranged.
CIRCLE SWAPS
If you can't attend your regular Circle, you may try to arrange a swap with another active Circle member through the designated Fearless Movement community space.
You may also be able to attend another Circle where a suitable vacancy already exists.
Circle swaps and alternative sessions:
are subject to availability;
are not guaranteed;
are generally organised by members rather than by Fearless Movement;
are available only to active Personal Training Circle members; and
must be confirmed by Fearless Movement before attending.
Fearless Movement may occasionally allow an additional person to join a Circle to facilitate a swap where we consider this appropriate, but this isn't guaranteed.
If a suitable swap or alternative place isn't available, the missed Circle session is forfeited.
If you know in advance that you'll be unable to train for a week or longer, the membership hold provisions in Section 5 may be more appropriate.
9. CLASS PACKS
Class packs are separate from ongoing memberships and are subject to the validity period stated when purchased.
Current validity periods are:
5 Class Pack — 8 weeks
10 Class Pack — 13 weeks
20 Class Pack — 26 weeks
Cancelling a booking does not extend the expiry date of a class pack.
Unused sessions remaining after the pack expiry date are forfeited except where Australian Consumer Law requires otherwise or Fearless Movement agrees to an extension because of exceptional circumstances.
10. WHEN FEARLESS MOVEMENT CANCELS A SESSION
We have responsibilities too.
If Fearless Movement cancels an individual Pilates & Movement class, affected members will receive an appropriate replacement class credit or other reasonable alternative.
If Fearless Movement cancels a Personal Training Circle, we will, where practical, offer an alternative Circle, rescheduled session or another suitable arrangement.
Where we can't reasonably provide a replacement, an appropriate account credit or adjustment will be made.
We don't expect members to simply lose a service because Fearless Movement cancelled it.
11. LOW CLASS NUMBERS
Fearless Movement may occasionally cancel a group class where minimum attendance isn't met.
Where we cancel a class for this reason, affected clients will receive the same replacement credit or alternative that applies when Fearless Movement cancels a class for another reason.
Where a particular class regularly has low attendance, we may review or change the timetable rather than repeatedly cancelling the class.
12. TIMETABLE CHANGES AND SUBSTITUTE INSTRUCTORS
Our timetable may change from time to time as Fearless Movement grows and in response to attendance patterns, school holidays and other practical considerations.
We may operate a reduced or modified timetable during school holidays and similar periods and will provide reasonable advance notice of planned timetable changes where practicable.
Fearless Movement may also use another suitably qualified and appropriately insured instructor or coach to deliver sessions.
Where the membership service remains reasonably available, membership payments will continue as normal.
13. FEARLESS MOVEMENT CLOSURE PERIODS
Fearless Movement may take planned breaks during the year.
Where Fearless Movement closes for a full week and the services included in your membership aren't available, your weekly membership payment will be paused for that closure period.
For Personal Training Circle members, a Fearless Movement closure does not extend the initial 12-week minimum commitment.
This is different from a hold requested by the member. A member-requested hold during the initial Circle commitment extends the commitment period; a closure initiated by Fearless Movement does not.
If suitable replacement instructors or alternative services are available and membership services continue to be provided, normal membership payments may continue.
14. FAILED PAYMENTS
Membership payments may occasionally fail because of insufficient funds, expired cards, banking restrictions or other payment-processing issues.
If a payment fails, please update your payment details or arrange payment as soon as possible.
Fearless Movement may temporarily suspend membership access and future bookings while an amount remains overdue.
Any payment-processing or failed-payment fee charged directly by the payment provider may also apply.
We won't add our own arbitrary penalty simply because a payment has failed.
15. MEMBERSHIP PRICE CHANGES
Fearless Movement may occasionally need to change membership pricing.
We will provide at least 28 days' written notice before any change to your recurring membership price takes effect.
For Pilates & Movement memberships, the new price will take effect after the notice period. If you don't wish to continue at the new price, you can cancel using the usual 7 days' written notice.
If you are still within the initial 12-week commitment of a Personal Training Circle when a price change is announced, your existing membership price will remain unchanged for the remainder of your 12-week commitment.
The new Circle membership price will only apply after your initial commitment has been completed.
If you don't wish to continue your Circle membership at the new price, you can cancel by providing the usual 7 days' written notice, with your membership ending no earlier than the completion of your initial 12-week commitment.
We won't change the price you agreed to for a Personal Training Circle part-way through your initial commitment.
16. MEMBERSHIPS ARE PERSONAL
Memberships, Personal Training Circle places, class entitlements and pack credits are personal to the person who purchased them and can't be transferred to another person unless Fearless Movement expressly agrees.
Personal Training Circle swaps are an exception only in the sense described above: they allow active Circle members to exchange training times.
They don't allow a member to give their session to a friend or another non-member.
17. HEALTH, INJURIES AND PARTICIPATION
Exercise involves physical exertion and some inherent risk.
Please tell Fearless Movement about injuries, health conditions, pregnancy, changes in your health or other circumstances that may reasonably affect your participation.
You are also responsible for letting your instructor or coach know when something has changed or when you need an exercise or session adjusted.
Fearless Movement may modify or restrict participation where reasonably considered necessary for safety or where the service is outside our professional scope.
Our aim is to work with you and your current capacity, not expect you to arrive feeling exactly the same every week.
18. AUSTRALIAN CONSUMER LAW
Nothing in this agreement excludes, restricts or modifies any consumer guarantee, right or remedy that can't lawfully be excluded under the Australian Consumer Law or other applicable legislation.
Where Australian Consumer Law gives you rights beyond those described in this agreement, those rights continue to apply.
19. CHANGES TO THESE MEMBERSHIP TERMS
Fearless Movement may occasionally need to update these terms as the business, timetable or services change.
We will provide reasonable notice of any change that materially affects an existing member's rights, obligations or membership.
We won't use a change to these terms to retrospectively remove rights or impose a materially more burdensome condition without providing an appropriate option for affected members to end their membership.
20. ACCEPTANCE
By purchasing a Fearless Movement membership and confirming that you agree to these terms, you acknowledge that you have had the opportunity to read and understand:
the membership you've selected and its weekly price;
what is included in that membership;
the 7-day cooling-off period;
the 7-day cancellation notice requirement;
the membership hold arrangements;
the applicable booking, cancellation and no-show conditions; and
the Fearless Movement Booking, Cancellation & Attendance Policy.
If you're purchasing a Personal Training Circle membership, you also acknowledge that:
your membership has an initial 12-week minimum commitment;
it continues week to week after those 12 weeks unless cancelled;
your regular Circle place is reserved for you;
missed Circle sessions aren't automatically credited or made up; and
Circle swaps are subject to availability and aren't guaranteed.
If you're unsure about anything before joining, please ask.
We would much rather explain something before you sign up than surprise you with it afterwards.
